DESCRIPTION/TIMING: The “The Tim Tam Down Under Discovery Sweepstakes” (“Sweepstakes”) begins at 12:01 a.m. Eastern Time (ET) on 12/08/08 and ends at 11:59 p.m. (ET) on 4/30/09 (“Promotion Period”). Promoter’s computer is the official time-keeping device for the Sweepstakes. A random drawing will be held at the end of the Promotion Period to award the Prize (“Prize Drawing”).

HOW TO ENTER: Complete and submit the online entry form found at www.ilovetimtamcookies.com for receipt by 11:59 p.m. on 4/30/09. Limit of one entry per person or e-mail address per day, regardless of method of entry. Multiple entries from the same person using the same or different e-mail addresses are prohibited and all such entries will be void. Entries generated by script, macro or other automated or mechanical means will be void. In the event of a dispute regarding the identity of an online entrant, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses or the domain associated with the email address. Sponsor will collect information from the entrant solely for the purpose of notifying winners and awarding prizes, unless entrant indicates that he/she would like to receive additional information from Sponsor.

ELIGIBILITY: Sweepstakes is open to legal residents of the 50 United States and the District of Columbia, age 18 or older as of the date of entry. Employees, agents, representatives, directors and officers of Pepperidge Farm, Incorporated (“Sponsor”), its parent company, affiliates, subsidiaries, distributors, retailers, advertising and promotion agencies, electronic media firm, Mr. Youth LLC, Sweepstakes Consulting, LLC, entities engaged in the development, production or distribution of sweepstakes materials, and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in the same household, whether or not related, are not eligible. Sweepstakes is subject to all federal, state and local laws and regulations. Void in APO/FPO addresses outside the U.S., PR and where prohibited by law. U.S. law governs this sweepstakes.

GRAND PRIZE: One (1) Grand Prize: A trip for two (2) to Sydney, Australia. Prize includes roundtrip coach class air transportation for two (2) between a major metropolitan airport nearest winner’s home in the U.S. to Sydney, Australia, 7 nights double-occupancy hotel accommodations, and $1,000.00 in spending money Approximate retail value (“ARV”): $8,000. Odds of winning depend upon the number of eligible entries received.

PRIZE RESTRICTIONS: Prize will be awarded within 2-4 weeks after the Promotion Period ends, subject to Sponsor’s verification of eligibility. Actual ARV of Grand Prize may vary depending on departure date/time and departure city. All travel dates and arrangements are at Sponsor’s discretion and subject to availability. Trip dates must be selected by 12/1/09 to allow time for booking or winner forfeits prize in its entirety and an alternate winner will be selected. Travel must be completed by 5/5/10. Winner and guest must travel together on the same itinerary, and are responsible for obtaining all necessary travel documents. Winner and guest are responsible for obtaining travel insurance (and all other forms of insurance) where applicable, at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Airline tickets and hotel accommodations are subject to terms and conditions specified thereon. All airline tickets issued in conjunction with prize are not eligible for frequent flyer miles, and no code-share flights may be used. Prize components cannot be used in connection with any other promotion or offer and no portion may be separated except at Sponsor’s sole discretion. Sponsor will not replace any lost or stolen tickets, travel vouchers, certificates or similar items once they are in the Grand Prize Winner’s possession or in the possession of Grand Prize Winner’s guest. Any expenses not mentioned above are the winner’s responsibility. Taxes are the winner’s responsibility. Prize is not transferable or redeemable for cash. No substitution for prize except as may be necessary due to unavailability, in which case a prize of equal or greater value will be awarded, at the Sponsor’s sole discretion. Prize is awarded “as is” with no warranty or guarantee, either express or implied.

RANDOM PRIZE DRAWING: One (1) Grand Prize winner will be selected on or about 5/8/09 in a random drawing conducted by Sweepstakes Consulting, LLC, an independent judging organization, from among all eligible entries received. Decisions of the judges are final and binding on all matters relating to the Sweepstakes.

WINNER VALIDATION Potential winner will be notified on or about 5/12/09 by e-mail or mail and will be required to complete an Affidavit of Eligibility and Liability/Publicity Release (“Affidavit”) that must be returned via e-mail or mail within fourteen (14) days of the date and time of notification or prize will be forfeited and an alternate winner will be selected. Failure to return any and all documents specified, a prize or prize notification being returned as undeliverable, or potential winner not complying with any term of these Official Rules will result in entrant being disqualified and the prize being awarded to a potential alternate winner. Winner’s travel companion will be required to execute a Liability/Publicity Release before prize travel will be booked. If companion is a minor, he or she must be accompanied by a parent/legal guardian, and his or her parent or legal guardian must execute this Release. Prize acceptance constitutes permission (except where prohibited) to use winner’s name, city and state of residence and likeness for advertising and publicity purposes in any and all media now or hereafter devised worldwide in perpetuity, without additional compensation, notification or permission. The collection of any personal data is subject to Sponsor’s privacy policy at www.ilovetimtamcookies.com and will be used solely for the purpose of notifying winners and awarding prizes, unless entrant expressly agrees to receive information from Sponsor. Entrants, by participating in this Sweepstakes, (i) agree to be bound by these Official Rules and the decisions of the Sponsor and judges, which are final and binding in all matters and (ii) hereby waive and release, and agree to hold harmless the Sponsor, its parent, subsidiaries, affiliates, distributors, retailers, electronic media firm, Mr. Youth LLC, Sweepstakes Consulting, LLC, all prize providers, and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”), from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause of thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of a prize (including any travel or activity related thereto) in the Sweepstakes, or their participation in the Sweepstakes, or their participation in any Sweepstakes or prize related activity. Released Parties are not responsible for lost, late, misdirected, damaged, delayed, incorrect, incomplete, garbled or illegible entries or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials. Released Parties are not responsible for any injury or damage to entrants’ or any other person’s computer related to or resulting from entering or downloading any materials in the Sweepstakes. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the sweepstakes. Persons who tamper with or abuse any aspect of the Sweepstakes or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. The Grand Prize will be awarded. Sponsor’s failure to enforce any term of these official rules shall not constitute a waiver of that or any other provision. Entries become the sole property of the Sponsor and will not be returned.
